    Can a landlord refuse to prorate rent?
    I have asked my landlord for an extra five days to move out. They are refusing, stating that I have to pay the full month's rent if I stay those extra days. My apartment has not been rented to anyone else as of yet. Is this legal??

    Yes, your landlord can do this. How do you know they haven't found someone ready to move in? Even if they haven't, your contract is up. As long as you are living there, they can't rent it to someone else. Maybe they won't have a tenant until June or later. But, they are under no legal obligation to agree to prorate the rent as a convenience to you. Sorry.

    Your landlord is not a motel or a hotel. He rents by the month or by the year. If you have possession of the apartment for even one day in a month, you have rented that apartment for the month.

    Why are the 5 days so important, why can't you move out on time, if you want to save this last months rent and don't have a place to stay those 5 days stay with a friend or family member and rent a storage unit. A storage unit large enough for all your stuff should still be far less than a months rent.

    Same with me my husband got deployed on the 7th and my landlord told us she would prorate it as soon as some one knew moved in, and now she is saying she never said that.. also she used my pet deposit for cleaning and damages to the apartment.. I'm there with you,. its f'ed up!
