    I purchased a home that I let my boyfriend move into with me and my 2 children. We have lived there for 5 years, almost 6 years. We had been together on and off for 10 years. He lived with me for a while in my apartment in Portland. Things aren't working out between us, and I want him out of my home, and he said he will put a lien on my property to get half the equity that it has gained. I don't know what my legal rights are. He has barely done anything to upgrade that home. The mortgage is in my name as well as the phone and lights. He has a cable bill in his name and thinks that he can use that showing that he was living with me. I want him out of my home, but am not sure how to proceed. As far as I'm concerned, we've been only roommates for the past 4 years (no intimacy)Any advice you can give me would be greatly appreciated. I can provide more detail if needed. I don't feel he has rights to my property and how can he put a lien on it?

    I'm at my wits end. Help?

    First, its not a good idea to piggyback your question on someone else's thread it can confuse matters. So I've requested this me moved to its own thread.

    Assuming the deed and the mortgage are both only in your name, its unlikely that he will be able to make a case. He would have to prove that he has contributed to payments on the mortgage to get any share of the home. And that would be very hard to prove. If he was making payments, you could state that they were rent payments.

    The only kicker is that, he might claim community property as a common law husband. You should consult an attorney about that possibility. If he has never paid anything more than the cable bill, you can problably just tell him to leave. But, to be on the safe side, I would go through formal eviction.
