    Can a collections agency place a lien on my home if it has a joint owner on it?
    Hi,

    I am a single woman with a live in friend. We bought a home together and two vehicles. I bought some equipement a few months ago but after a financial hardship could not afford the monthly bill. The company sold the account to another agency and now that agency is threating to take me to court, garnish my wages, place a lien on all property. I tried to set up a monthly payment, but they would not accept anything less than $1,200 down and $75 per month, I can not afford this and have advised them of this. They do not want the equipment back and actually refused any payment below the above mentioned amount.

    I just want to know can they put a lien on any of my property if there is a co-owner?

    Yes they can AFTER they take you to court.
    Many people are not paying the collection agencies because they demand too much that nobody can afford. So most people are letting it go into default, cross their fingers and wait and see if they get a court date. Keep as much as possible out of your name.
    They can put the lien even if it is co-owned but your partner would have to make arrangements at the bank for their money not to be taken out of a joint account.
    Your co-owner would not be responsible financially unless they co signed the loan as far as I know.
