    Breaking a rental lease
    My partner and I relocated to Florida two months ago for him to take a new job. When we arrived the job never took place. We both have not been able to find work in Florida and in the meantime his old boss offered him his job back. He accepted because he couldn't find work here in Florida. We rented a small Villa and have signed a year lease. We have given the landlord $1,200 security and the first and last months rent. We are moving back home on the 7th of February and the Landlord is making us pay for the full months rent and there after until she rents the house again. We cannot afford to pay the $1,065.00 a month on top of our apartment rent back home. The stress has been so unbearable on the both of us and has now affected our health. I have a serious health condition and am now having problems with it due to all the stress. The landlord is not budging for us at all. We know that we are breaking the lease and really feel bad about it but what were we supposed to do if we couldn't find work?
    Please help. We both are very distraught over this and we only have enough money to get us back home for my partner to start his old job back. Is there another way that we can get out of this without her taking us to the cleaners financially?

    What help do you expect? You signed a contract (the lease). You are required to live up to the terms of that contract. The landlord is within her rights to require that you make the payments until the unit can be re-rented.

    So your only recourse is to find someone to take over the unit.

    You owe the money, no way out of it, you have a choice to either go on a better budget ( and perhaps should have rented a cheaper place back home)
    Get rid of cable TV, internet and so on, and find the money to pay him)

    But don't get sick over it, so you can't pay him, then don't pay if you can't, if you just don't have the money what can you do?

    So you don't pay him, he will sue you and get a judgement if he wants to do that. He may not, who knows. If he does, he gets a garnishment of your pay till he is paid off. Worst things have happened.

    But no, you are obligated to the terms of the lease.

    I'm sorry about your plight but there is no way you can get out of it unless, out of your landlord's goodwill- by waving what you owe him. Get out & look for somebody else who will rent out the villa again to replace you guys! Otherwise, you'll end up in serious debt and failing health. However, do not allow the situation to totally distraught both of you and your partner; it will come to an end in due time & you'll both be able for it!

    See if your landlord will do a buy out. Yes, I know money is short, but it is better for you as well as the landlord to solve this problem now, rather than have to appear in court. Think about it. Is she takes you to court and you do not appear, she will win the case and get a judgment. It will leave a mark on your credit report and a possible garnishment. Not worth it. See if you can't work it out with the landlord. Put an ad in the paper and see if you can help the landlord re-rent the property.
