    What rights does my sons father have
    My sons will be 2 this week. His father has seen him 3 times in his life. We are in court because I am filing for custody. Recently at the support case he asked for a paternity test which the results came back of course that he is the father. So he is saying he wants to see him but he has never made the effort to see him. He never calls I do not even know his address. So he is the reason he does not see his son. So I want to know does he have rights. Oh also when my son was born he was in jail so he did not sign the birth certificate, and I did not put his name on it bacause he was not around for my pregnancy or the birth. So does he have rights now that he got a paternity test?

    Yes, the father has rights, whether up until now he has seen his child or not.

    They can set him up with his child support and visitation, but he will have rights to the child. Having not seen him will be a factor, but it may not be a huge factor.

    He does have rights. I understand it's easier said than done but don't allow your personal grudge for your ex stand between him having a relationship with his son from this point on. You're right, he made the choice to not be involved the first 2 years or during the pregnancy but don't stand in his way now. Ragardless of the fact that he didn't sign the birth certificate, he still has rights to see his child and the paternity test seals the deal. If you two can't work out a civil agreement, let the courts set it up. But keep in mind, that the paternity test also proves that he fathered a child and will have to take financial responsibility in providing for him. No more excuses.

    My son split with his partner.she left family home and will not let him have any contact with their 7 year old son . She has even stopped grandparents contacting school as to their grandsons wellbeing, is this allowed if so why ?
