First remember a POA is not a guardian, if the person is not capable of making their own choices, a guardian needs to be appointed. A peson with a Power of Attorney, only gives that person a right to sign for them, but the person still has a right to sign for thierself also, a power of attorney does not take that away.
Next the government is not "taking" the nursing home is billing for services. Most nursing homes cost about 3000 a month at least and medicare will only pay a small part of it. All of the persons money and even their house can be ( and should be) used to pay until it is gone.
Anything else is theft and you can be charged with theft ifyou try to hide money from them.
So what you are asking is illegal and is cheating the nursing home.
