    Divorce and 401K
    Hi.
    I believe it is federal law that the spouse is the beneficiary... therefore, does he have right to take out a loan without my permission as he knew we are divorcing, also he has been dishonest, as he said it was for a residential refinance, and in the end... it's not going here, foreclosure is imminent. He works in IL, we live in WI, and his very small company is fully aware of this lie. HELP!! :confused:

    I don't know the answer regarding any violation of federal law here, but... if you know that he has the 401(k) assets in his possession, then you should insist on him giving you your half as part of the divorce settlement.
