    Why didn't my son have a autopsy he passed away in the hospital?
    My son died in the hospital in march2011 the doctor saw Tuesday said he'll probably go home tomorrow ,the nurse made us leave she said we were disturbing my son he was 44,we were actually having lunch with him and watching TV. He was happy she gave him medicine through the iv.and left he had a weak heart and other illness but all under control .the nurse said she was sorry she left him for 15 minutes the machine was beeping not one nurse went to see why he was in IOU,someone came after 15 minutes called code blue he was resuscitated he had a heart attack one doctor says one of3 medicines caused the heart there are a lot off irregularities but his death was caused by neglect. I have talked to lawyers. No one will touch the case .because he did not have an autopsy ,we did not know he did not have one ,we asked for an investigation before he had the heart attack because,he was in IOU.we were there 3 hours no one checked to see in to see if he needed something or how he felt.why no autopsy? Thank you.

    Because the hospital or doctor who reported the death called it from >>> what ever the report says. Most likely heart failure ( if it was his heart)

    If you want a autopsy, you can pay for one from a independent group that does autopsy.

    Id take it to court something went wrong there you have the rights...

    Evidently you waited too long between the date of death and when you first consulted with these attorneys. Have they not explained to you, as Fr_Chuck has, that an autopsy is not normally required when a patient dies in a hospital and the attending physician is definite, in the death certificate, about cause of death?

    I am assuming that your son has long since been embalmed and buried, and therefore at this point an autopsy would not reveal the facts they need to prove to establish negligent treatment. Is this correct?

    I hao no idea he had no outopsy the lawyer that had the case fok about 7 months returned all my paperwork 3 weeks ago a lot of advice about filing hjs last words under no condition will I take this case.my son was cremated we thoght he had an autopsy because we made so many complaints .I fouhd out 3 weeks ago.

    Talk to other attorneys. I for one (although I don't do a great deal of medical malpractice law) am not sure why an autopsy would be necessary.

    An attorney may get a copy of all doctor and hospital forms and records. They can have those examined by other doctors who will see if there is anything not following normal procedure.

    But all of this is going to cost money, I can't believe an attorney will not take a case if offered to be paid.

    If you want them to work only if they win, that is the issue, they don't see a good chance to win. So you will have to offer to pay them for their time and all the expert investigation
