    Tranferring an apartment rental agreement
    If I have been residing with my mom since 1981 and she passed and the landlord knows this, would I be liable for paying first and last month rent?:confused:

    Hello kevan:

    Your moms business relationship with the landlord ended. Yours is just beginning. IF, your mom paid her last months rent and a deposit, those monies become part of her estate, and her heirs (you) will get it. Yes, the landlord will probably want those monies replaced. If you stay, you'll probably be the one who has to replace them.

    If your name was on the lease, then yes. If not, the landlord may still try and get you to pay rent for the time you lived there. Any small claims court judge would probably award it to the landlord, the reasoning being that if you were living there, then you should pay rent.
