    Rear End Collision - Liability Coverage
    Hi

    I was driving a friends car who doesn't live in US anymore. He wanted me to sell his car so I was coming from Walmart after getting a new battery and a tire when while waiting on a red light I was rear ended. Its an old car and I had liability coverage on it. I was going to sell the car for $2500 before this happened. Damage to the car is easy $3000. Now when I call my insurance company so they can work with the other insurance company they said I should work myself since I have only liability coverage.

    I just want some suggestions before I call this insurance company. Since I don't own the car how is it going to work out. Since my friend is outside US, are they going to send check to my address or his address.

    You need to get a power of attorney from your friend giving you the authority to negotiate with the insurance company and receive a settlement from them.

    Please understand that a POA will not allow you to go to court for your friend. So another option would be to have the title transferred to you.

    Thanks for your reply. Power of attorney sounds reasonable but if I transfer the title, wouldn't the date of title show that it was transferred after the crash? I can transfer the title to my name but will that help?

    Your friend could give you an assignment all claims regarding the vehicle. That would make the date of title transfer not a problem.

    To protect your friend, you should also have a written agreement with him specifying what he will receive.
