My ex boyfriend took my car... we co signed it on the title... what should I do ?
We both signed the title... I moved away and came back and he wouldn't give my car back... he had a car and got rid of it... so he kept mine... I came back and told him I wanted my car back. And he won't give it back.. tells me I have to give him 300 dollars to get it back... when we traded the car... and it was under my insurance and I took it off after we broke up... so I have no idea if he has it covered.. because he moved to other state with this new girlfriend he left me for... He does not even have to give it back, if his name is on the title to the car, he is as much owner of the car as you are.

If he will "sell" you his share for 300, get it in writing.

Being that you won't married then take it to the cops. If he don't have insurance on it the notify his local police to watch for the vehicle and get him charged foir no insurance

And if your name is on top of his on the title then its more yours then his

I called the dmv told me to get a lawyer and go to court about it... he has the title and everything to the car.. so I can't even prove that I own it till I get a copy of title and reg. which takes 8 weeks...

And then I would have to take to small claim courts.. and he knows people that he can get rid of the car without knwin it... and I'm pregnant with this kid and he doesn't care if I don't have a car.. just a huge mess.. left me with no money

Just having your name first on a title means nothing. Titles are usually John Smith AND Jane Doe or John Smith OR Jane Doe.

Either way you own half of the car.

If this is his kid be sure to file for child support on this deadbeat.

Did you go in person to the DMV and get copies of the title and registration? You should not have had to wait 8 weeks. 8 weeks is for doing stuff in the mail not in person.

As owner of 50% of the car you are entitled to use of it, he is denying you use of it, therefore you have a right to sue (though I would caution you to evaluate the value of the car against the cost of getting it back). As the co-owner you would be liable for any cost associated with it (parking tickets, taxes, etc.. ).

So either fight to get it back or sign over title to him. If the car ends up in an impound lot racking up thousands in fees your liable as an owner.

As co-owner he is as much entitled to the car as you. Unless you can prove that you paid for the car, a court is likely to tell you that you need to buy him out. So if he'll turn over the car for $300, I would go that route.
