    I am being sued for credit card debt
    I just got a call someone from a law firm named ……and asked me if I wanted to get lawsuit from my credit card company (Bank of America). The unpaid balance was from about 8 years back and when I was I different state (Massachusetts). Now, I am in Illinois and I’ve been getting the letters from the collection agencies and I do not recall any letters from Law firms. Of course, my fault I was just ignoring all of them.

    Now, when I got the call from that guy in my cell phone, I thought it was just a call and when he asked if I wanted to settle down the balance or get sued, I said I wanted to get sued. Then he told me that my court hearing date is April 18, 2008 at Cook county federal court (Illinois?? ) and today is April 2, 2008. Before, I asked him any questions, he just hung up the phone.

    The name of the law firm, I tried to check on website, I could not find probably I did not catch the right name. I also called from different phone on that guy’s phone, he picked it up, he picked it up maybe that was his cell phone but no name of the firm and I just hung up the phone without talking-to him.

    My question is, am I not supposed to get a letter from court about the hearing date by now since the court appearance date is so close?
    Why did he not want to listen to me and hung up?
    Should I call him and get more info. what is he really up to.

    I really appreciate of your input and help as I am so scared right now.

    First, you don't get called into Court by telephone. You HAVE to be served with papers - nail and mail, personal service, service on a responsible party.

    It sounds like this debt is beyond the Statute of Limitations IF there has been absolutely no activity on the account for so long.

    Wait and see what happens next - sounds like there is little you can do at this point other than to tell them not to call you any more. And then hang up.
