    Accident involving Semi
    I was in an accident two weeks ago where I was rear ended by a semi on the interstate when I slowed down and he didn't. His insurance company has admitted liability so there is no issue as to who is at fault. My question deals with money. My car was vauled at $10,500 but I had 11,000 left to pay off. My GAP insurance covered the rest, but here I am left with nothing. I don't have anything to put down on a new car. What can I do?

    Oh and injuries.. I've just been super sore, nothing major.

    Hello karen:

    You can't do anything about a car except buy another one. If you're hurt, see a doctor RIGHT NOW. Don't sign anything from the insurance company.

    I have gone to the doctor and I was taken to the hospital right away. I then went and saw a specialist for my back. He said I had strained ligaments and muscles. I'm lucky that's all because he hit me doing 70mph.

    Anyway, someone mentioned to me about Diminshed Value... anything I can do there(the car is totaled I know but I'm trying to find anything that will help)? Also when I bought the car I traded in my old one therefore paying less. Now I have nothing to trade in. Also I made a stupid mistake by putting some of my car payment on a credit card. How can I claim that?

    Diminshed value is if you keep the car and it is no longer worth as much because of the accident. Because this was totaled out, there is no diminshed value.

    And honestly when you owe more than a car is worth, actually you were lucky that you did not still owe money, but now have a 0 balance.

    And you can't claim car payments, just the pure value of the car. That is all they have to pay you, the value of the car, not more money than the car is worth. ( one should not owe more on a car than it is worth that is a risk everyone just takes when they do that.

    They should come back to you to settle for your medical bills,

    So now you ar just going to have to buy a new car the best you can, Perhaps the company you had the loan with will give you a good rate loan.

    Well here is another question... this happened while I was on the road for work. I don't have an HR person so I don't know how to get the help I need. How do I deal with workers comp stuff... this is all very overwhelming right now for me.
