How should I approach my case at this point?
I'm currently going for custody of my son. I have joint legal (not physical). I went to court w/my attorney and FOC basically denied everything and we appealed. The situation at my sons home has changed, leaving him with babysitter until 3am on school nights. I'm also concerned for my son's mental behaviors as I've spoke w/his teacher (have a written report) he is doing horribly behavioral wise and this all came about in the last 6 months that is why I'm trying to get more time/custody. I have him working w/a social worker (who is making a report regarding all of my son's behavioral problems). My attorney said we should fight regarding the time, but when we went to FOC the ex, my son's mom said I'll just change my schedule. I suggested to my lawyer well can't we take the angle of my son's teachers and therapist... I mean COME ON its his welling being a stake here. My attorney thinks its all worthless, but isn't this the very reason I'm fighting?? YES. SO tell me what should I do and how should I approach this. Please help me, I seriously do not have money to be wasted. Your expertise and advise is more than appreciated its needed. My son is six years old

You can always fire your attorney, and get someone else.

Yes, but is this the approach I should take? We've only went to the FOC and that is it. I've given him A LOT of money to do something more? Do you think he is taking the right approach by advising me that those things (ie school, therapist) won't be the deciding factor, that her working night will? Do you think the school and his behavior should be included in this fight and have a huge barring on a child's "best interest?"

If your attorney is not saying you can win, you need an attorney who at least thinks they have a chance to win.
Now they may know this court and judges, I tell the story, of the lady who was the hooker, leaving children 10 and under alone for hours at a time, even bringing men to sleep with for money into the home with the children there. All proved in court, guess what mother keep custody of the kids, this judge and court always gives custody to mother unless there was physcial abuse. So is this something your attorney knows about the judges you are going to get?

Well, I say a social worker today with my kid. He said if he hears anymore he will have to call social services. As for my attorney he is confident he will win. Again, I asked the question of what should I do because my attorney seems so confident. Now I have a social worker in on this case and he tell sme he will have to interv because this abuse is so intense.
