    Dealing with landlady
    Hello all,
    I have a question referring to my landlady. She requires a 60 day notice to move out, I gave her a 48 day notice because I wanted to find a house first.
    She wants to conduct an open house while we are still living in the house.
    Even though I am pd up through february06. Does she have the right to hold an open house while we are still living in the home? She also said that I am responsible for paying for the month of march if the house does not get rented! She also is threatening me with her lawyer.
    Can all of this be true?
    Please help.. who do I call or does anyone know of a website I can go to see what my rights are as a renter?

    Yes I have lease. Nothing states her having an open house while we are still living here.

    Does the lease state 60 dates notice, if not you have give enough notice, make her live up to the terms of the lease.

    If you have a lease that states you have to give a 60 days notice, and you fail to give that notice, you can be held responsible for the rental payment up to that time frame. Basically 48 day notice is not enough. She is basically saying if she rents it out to someone else she will not hold you responsible to pay the next months rent. Sounds right to me. Although I would not have agreed to a 60 day notice in the first place.

    On showing the house. She can not have an "open house" but she is allowed to with notice show the house to speicific people. She can not allow them to wonder around your house without supervision, but she can take one family at a time though the house showing it. She will have to give you notice of when. I would say more specific than just a day, but would have to give you day and @ time for the house to be shown.
    Going by the rental laws in my state anyway.

    I am a real estate agent.. and I would personal direct you to a lawyer. Simply because it sounds like you don't know what agreement you have signed. Now as for finding a new place... if you don't have an agent working for you let me know and I will gladly help you. And in case you don't know this... real estate agents should not charge you anything for there services, it is the seller that will pay for both agents... dont want you to get ripped off or anything. I wish you luck and contact me if you should need an agent.

    You must follow your lease aggrement. Reread it fully. 60 notice means you must give 60 day notice and be paid in full up to those 60 days. I think if your lease states she can show your home to others she is within the law. If it does not state it, you can refuse. But, make sure you are paid in full the 60 days no matter if you live there or not the full 60 days. If you do not follow the lease agreement and do not pay the required amount, she can sue you and also have an eviction given. Not something you want on your record. Call a lawyer as every county has different rules. Also their should be a local office that handles these type issues.

    If you HAVE to do the open house tell her that you want it to be when it is convenient to you and you are home and available --and she gives you prior notice to make sure it is when you are available.

    It might be to your advantage if you agree to the open house because if she has to wait until you move out chances are she will not be able to get it rented by March and you most likely could be responsible for that months rent.
