    Can He?
    My husband and I been separated since Aug. 2007 and we have joint custody of our 5 year old son he get his sons every weekend, he give me child support but the judge cancelled his visitation, since FEB. 2008, since he failed to give the address, and who he lives with to the judge. He has not been back to court to attempt to see his son, and recently he called me to tell me that he is getting a divorce because he is getting married, and he is moving out of state. What happens with my son, I need him here I nearly got fired from my job cause I can't be taking off when my son get sick or they need me to pick him up from school... I have to work too... Can he just move??

    People up and leave their kids all of the time.
    As for your employer, I don't think they can fire you if you have documentation of your son being ill. Check into the Family Medical Leave Act. Also maybe you can get help with daycare through government assistance. I Have seen some daycares advertise that they let children come when they are ill.

    I tried to look into this and found mixed reports. It seems that it would depend on where you live.
    It is possible he would need to get permission from the courts to move since you have joint custody. But since visitation is on hold - it may not matter.

    Also, since you aren't divorced yet, you could contest it and see where that gets you.
    Do you have an attorney?

    What state? Is child support taken out of his check, or does he pay it? Does he pay to you directly?

    They take child support from his pay check I live in New Jersey..
