    Will my Drivers License be suspended for a year for no insurance ?
    I was in a minor fender bender accident in the store parking lot. I had no insurance at the time. I exchanged drivers license and name and address with other driver. We didn't exchange insurance information though. Week later her insurance company calls me and wants to know my insurance co. name. I refused to give it to him and he said he will just check records at DMV to find out if I was insured and if I wasn't insured at the time of accident that the DMV would suspend my drivers license. So I admitted I didn't have insurance at the time and he said I wouldn't get my license suspended unless it was reported to the DMV and he wasn't going to do it. But he wanted me to sign a paper admitting I didn't have insurance and then he would bill me for the damages for the other car. I don't want to sign anything because I don't know for sure if he won't get my license suspended. I agreed to pay for the damages though. What should I do? Should I sign something admitting no insurance or just tell him no and send me the bill... if I don't sign it what will happen? Please give me advice because I don't want to lose my license for a year. He says he won't report it to DMV but if I don't sign the paper he might report it or could report it anyway after I sign admitting it.

    You don't have to sign anything. DMV won't be interested in a fender bender in a parking lot, which is private property. How much is the damage and whose fault was it. Just don't admit anything, by signing you are dong so.

    The insurance company of the other person told me that if I didn't give him my insurance companys name he would be forced to search for it through DMV which would then instigate DMV to have to find out if I had insurance at the time and when they saw that I didn't have insurance the DMV would suspend my license for a year. Otherwise the their insurance co. wouldn't even contact DMV about it but if they were forced to find out that way my information it would raise the issue with DMV and get my DL suspended. I did admit it to them I didn't have insurance but now I do... and they can see the date of accident I didn't have it but how can they prove there was even an accident since there was no report or witnesses? I was almost completely backed out about to go forward she came in from off the street her front end bumpbed my rear. Tiny dent for her nothing on mine. Supposedly the person backing out is usually at fault not the person hitting them. Makes no sense to me. A person backing out has to turn and look every which way to make sure its clear, use their mirrors which make objects appear closer than they are... they are going backwards and can't see in their blind spots or cars that suddenly come up on them out of nowhere... when the person that hit me had clear open view of where she was going, wasn't relying on mirrors, or having to turn her head around like excorcist.. to see everywhere at once... she was moving forward coming towards me and I'm just trying to get out of my spot. Why wouldn't it be more her responsibility to watch for me... shes coming in towards me and should give me the space I need to finish backing up and not ride up on my rear... if you hit someone from behind on the road its usually your fault not the car in front that you hit their rear... so why is it usually always the person backing up at fault doesn't it make sense that she had more advantages of being able to avoid me and see me than I did of her? Sorry this is so long.

    He is not going to take the time to search for that information. He is trying to bully you. As far as I know from personal experience, the accident happened on private property so it is basically no fault and no police report or anything else. Yes, I agree about logistics. He can't make you pay.

    Im posting my question again because I think my question needs to be more clear in order to get the answr I'm looking for.

    My concern is that I had a parking lot fender bender and no insurance at the time... I am told that the dmv suspends your DL for a year if you are found to have not been insured at the time of an accident.
    My concern is that the insurance company of other person will report the parking lot accident to DMV which is what it says your supposed to do on the DMV website that you have 10 days to report it... if its reported the DMV will see I didn't have insurance. The DMV website for CA says that if you don't report the accident you lose your DL and if you didn't have insurance you lose it for 4 yrs I think.. there is really a good chance that this could happen and I don't want to just guess about it... I need advice from a person who KNOWS. Not an opinion... If you are just saying what you assume will happen... thinking that the other insurance co is just bullying me... when in fact you aren't sure if he is telling the truth or bullying me... then please don't assume one or the other and tell me your opinion as if it were fact. I can't afford to lose my drivers license.. No disrespect to the person that replied but I have been told by people before not to worry about something and found out later that I should have worried about it and done something because I suffered severe consequences listening to a friend assure me that nothing would happen... Does anyone know for a fact what will happen here?

    Ok, first guess what the other insurance company rep just got a bonus, he got you to agree to pay, If you had just told the other person to send you a bill, then there would be no insurance involved at all.

    First was it really your fault, if it was, write them a check and get over it.

    Next depending on the state, if your DMV keeps these reocords as soon as your policy expires the state will be notified anyway.

    Also normally once they are notified your insurance has laspe, they suspend your license automatically.

    But the guy from the insurance company only wants to scare you to force you to pay, they are doing what is called black mail.

    The state will already or soon know that your isurance has expired, best bet get new insurance now, so if they check you will have it.

    Next don't agree to black mail over the phone again.

    If you hit the other party.. it's your fault, so write a check and get yourself an auto insurance asap. Don't play game, damage from this game playing will cost you more.. much more.

    Hi lawanwadee, an accident in a private parking lot is still a gray area for most insurance companies. There were apparently no witnesses and police will not come because it is on a private area. He was backing out, she hit hm. Who knows, I personally won't tell him to pay. Her insurance company is using unnecessary scare tactics to make him pay.

    But I will say, as chuck did, get insurance NOW, which will mend at least two or three fences.

    My son had an accident in my vehicle 6/2012 because the alternator shut the car completely off. He barely touch the rear of a vehicle, but he hit a fence to avoid anybody getting hurt. The police even stated there was not $50 worth of damage. My insurance was active for 5 minutes, being that I paid it before he left the house 5 min prior. Insurance company refused to pay for anything. No citatations were given outside of him following to close, being the officer could not prove any different. Now, its 8 months later, I get a letter in mail this chick wants $14,000 for pain suffering of the company says they can have my license suspended. Talk to an attorney friend, he says no judgement has been filed against me, so the company is bluffing. Can they have my license suspended?
