    Tax Filing on OPT to H1B status
    Hi,
    I was on OPT from Jan till Sept 2008, and from Oct1, I was on H1B. No social Security taxes have been deducted off my paychecks till Sept, but after that yes. I have been with one employer all this while and I have one W2
    Can anyone please tell me what's legally correct to do while filing taxes? I have read so much about people looking for workarounds to save few dolars and even though they don't qualify for resident status, they do file that. Can someone please let me know what's the best way to do this legally?
    1040NR? Is there a way that I can separate and show my time on OPT and H1B in my tax forms?

    More of a tax question than immigration. If you worked and were paid on OPT, you must file taxes. If not W-2, then 1099. Find a good tax preparer or CPA.

    Dear Sir:

    You must report the income for tax purposes and should ask your employer to provide a 1099 for income tax purposes or you list is on the tax return as other income.
