    Forcefull Divorce before indefinite visa in uk
    Hi ,

    My Cousin got married to the British card holder in June 2008 in India and after a month they flew down to UK and been staying there since then but now her husband is having an affair with some one else and harassing my cousin, in fact recently he has started hitting her too.above all his family member like brother and mother are also not supporting my daughter.
    So, please tell me in case if she gets Divorced before completing her 2yrs with him , would she be deported back ( she is on spouse dependent visa there )? And if yes, then can you suggest the way of getting the visa there as she has a very good job there and can take care of herself.

    Whilst there are laws to protect victims of domestic violence there are also Immigration rules in place that have to be fulfilled. If this is a genuine case of domestic violence and the relevant authorities have been notified then in conjunction with the UKBA it is possible to file for further leave to remain without completing the 2 year probationary requirement.
    It would be too easy for everyone to cite domestic abuse as an excuse to stay in the UK without firm factual proof it has happened.
