    My dad is married but has some legal issues, can he still file for me?
    I have been in the U.S for five years on an F1. My dad came, got married, and moved to NC with her. They were in the process of applying for a green card for my dad, but he got arrrested. I think he was charged with a felony. Long story short the court is deciding whether he should stay or leave in a couple of months. I was wondering if my step mom(not official) can file for my green card (I am 19 now)? Or would it be possible to be adopted by her, then she could file for me?
    (My dad and her are still legally married)

    If you were under the age of 18 at the time of the marriage of your father and stepmother, then you are a child of a USC for petitioning purposes. Typically, you are included in the parents petition, so I would check with the attorney that filed the case.
