    Does temporary lay off an exempt employee affect their status?
    I work in New Jersey and may be laid off for 1 week per month to cut costs. Will this effect my exempt status?

    Hi,

    By being laid off you will be affected psychologically. It can affect your status if you are the only one to be laid off.. if there are many more colleagues being laid off your status will not be afected.. but it is not a good way of cutting cost.. anyway do try do find out another job.. so that when you are free during the one week you can still do something and earn some money.

    Exempt or non exempt is not affected by a layoff or downsizing.

    Exempt or non exempt simply refers to the employee classification according to the Fair Labor Standards Act.

    Exempt refers to being exempt from overtime and non exempt refers to being not exempt from overtime.

    The exempt salaried classification depends on the job being done and the componants of that job when referring the FLSA and the exempt classifications listed in the Act.
