my son is wanting custody of his son who is in foster care
This is such a confusing situation and we cannot seem to get answers from anyone. My sons ex-girlfriend had a child that we did not even know about. She had told him she was pregnant when they broke up but then no one ever heard anything else about it, so we assumed that she was just using pregnancy as a tactic to keep him from breaking up with her.
Then in Feb. 2009 papers were served to my son saying that DSS had taken the ex-girlfriends daughter and would also be taking his son when he was released from the hospital. The baby was born 3 months early and addicted to drugs, her daughter was also born 1 year ago addicted.
My son has custody of his daughter and they live with me. His daughter has her own room and the baby would also be able to have his room. However DSS is making him jump through hoops and he is getting no where. He does have convictions of drug related problems that were in the past. He has been clean for 2 years. Went through parenting classes, drug abuse classes, and anger management classes when he found out that he was going to be a father 2 years ago. Now DSS is making him go through all this again plus take random drug test for this child in which he does not care to do so. However the baby has been released from the hospital and went to the foster care parents. My son is only allowed to see him one hour a week. I have not been able to see him at all and I am his grandmother. I filed for custody also just in case they would not let my son have him. I have never even been contacted by DSS. Now they have filed for him to pay child support due to the baby being in foster care and him admitting to being the father. My question is he is wanting custody has worked with DSS since he found out that the baby was born, the mother has yet to even join one of the classes. But they still are trying to make him wait the 12 months to straighten up even though he is straightened up. We don't know where to turn. This baby is going to bond with the foster parents but he has a father and grandmother who wants him and can provide for him. Does anyone know where a person can turn for help? We cannot get any answers from DSS and every court date seems to be post-poned.
Sorry this is so long, I am just trying to give enough info so that if someone else has experienced something like this we might could get some answers.

    Get an attorney.

But it seems to me that DSS is just following procedure. If you want to hurry the process along, get an attorney who knows the court and DSS who will know what buttons to push.
