Wife falsely accused me of sexual assault
I caught my wife with my best friend, at which time she admitted to being involved with him. She wanted me to leave our home and child and I refused. She then told my sister a week later that I... this is embarrassing to say... masturbated on her face while she slept. 6 days later she went and got a t.r.o. on sexual assault and had me removed from the house! Went to court yesterday and because she told my sister this happened the judge did not want to hear anything I said. She had a lawyer I didn't because she took all the money out of our checking account and put it in her account that she opened. I am presently unemployed due to back surgery and she took what little money I get from unemployment each week. She now has a permanent restraining order,my daughter, the house, and 80.00 a week child support. Do I have any recourse here?? I lost everything and did nothing! Legal aid won't help me because I don't have custody of my daughter. I don't have money for a lawyer but definitely need one. What can I do?
    Thanks,
    Tom

Well first mistake was not having an attorney. And not sure how masturbating on her face was a sexual assault ? Even if it did happen.
So what visitation did you get for the daughter ?

So you save up money and file in court for modification as soon as you can

You write the judge a very nice letter explaining your difficulties to him and how you plan to deal with them; send your wife's lawyer a copy. Is your wife working? You have an alimony claim against her; the money in the account is yours, too. You need to hire a lawyer; until you do, you need to respectfully stand up for yourself.

Unfortunately, I can relate to your story. I have been married 15 years to a woman 9 years my senior. I thought things were good until I found she cheated on me. She blatantly admitted it but said it was with a woman (like that makes it better). I later caught her in several lies leading me to believe she was meeting this individual and tried to call her on this. We argued, I was distraut and went to a bar, later came home drunk and was accused by her of aggrivated sexual assault. After the fact I have hired a PI who found this girl was a guy and it had been going on for months. Over 2k phone calls and texts per month for several months not to mention meetings which she claimed were everything from working at other local hospitals for holiday money to going out with girlfriends. Now I'm facing F1 Criminal Charges, a Divorce and am not able to see my 15 year old son and so far nobody in the case wents to see her as anything but the "victim" and its all vindictive spite and false claims to control the case and destroy me.

I wish I had suggestions but a lawyer is a start. I have two, one for the divorce and one for the criminal case and thus far (6months) I'm already out nearly 40k counting the PI work and everyone still thinks she's the victim except my lawyer. I'm probably going to loose both the divorce and the case simply because I'm going broke and cannot afford to continue to pay lawyers much less "experts" to testify. My advice is honestly to pray. Ask God to deliver you from this hell because I don't see anyone else in this world who seems to care about this type of false accusation or claims.
