    When does judge listen to a child's input as to which parent they wish to reside with
    I have a eight year old son. Very mature for his age. His mother and I have no legal agreement as to custody. I pay child support. But she dictates when,where and how long I can see him when she allows. When can he add his input to this situation in court? He has mention a break times he sees that his mother is keeping us apart.

    ANY question on law needs to include your general locale as laws vary by area. This is also up to the judge. The judge can choose to talk to the child and then decide how much weight to apply. In every US state, this is at the judge's discretion, though there may be statutory guidelines.

    If the mother is blocking visitation, then you go to court to get a set schedule established.

    First you need to go to court and get court ordered visitation, so that there is a set time for the child to see you.

    And while the court may allow a child to say what they want, I have never seen a child much under 12 and often order allowed to testify. Even then what the child wants has little weight, it is what evidence for the better home that is looked at.
