    We have temorary emergency custody
    We have emergency custody of my husband's child (6months). What do we have to do for full custody?

    Your husband has to prove that the mother is unfit.

    It was my understanding that if the judge gave us custody that she would have to prove she is clean and stable before she would get the child back?
    #2 Should we take her to court while she is in rehab?

    What does the custody order say? You need to know the exact wording.

    When temporary custody is ordered, the custody order should spell out when the custody order will be reviewed and what the former custodial parent needs to do to regain custody.
