Suspect Child Abuse - Can I Keep My Daughter Home
My daughter's father has a history of being physically violent. Last weekend I had to go and remove her from his home during her court mandated 4 days visit. He supposedly (according to her) "ripped her out of a closet by her arm" because he was angry with her. I do not want my daughter to go to his house this weekend or any other weekend. She also does not wish to see her father anymore. We reported this to the local CUYAHOGA FALLS, OHIO police , and they obviously condone Paternal abuse of 13 year old girls. They said that it was to be considered corporal punishment, JUST Because SHE GAVE A BOY HER PHONE NUMBER!

I want to know the legal ramifications of my physically contesting his custodial rights with my daughter, and also need to know if anyone knows any inexpensive Akron, Ohio attorneys. I have ABSOLUTELY NO INTENSIONS OF EVER LETTING MY DAUGHTER GO OVER TO HER FATHER'S HOUSE EVER AGAIN, NO MATTER WHAT THE CUYAHOGA FALLS POLICE THINK IS LEGAL. Wonder what they would think if it was one of their daughters getting the crap kicked out of them? Hmmmm. Anyway, My daughter doesn't need to get beat any longer, and she even has bruises. I don't think the Cuyahoga Falls Ohio Police really care though, and I would love for them to know that I am blogging their lack of concern for a little girl's physical safety WORLDWIDE!!

Please help, I am really concerned. I am using an alias e-mail, so please just respond to me in this public forum.

    Thank You,

    Hi, fifthwheeldad!

Did you also report this to your local Department of Children and Family Services?

Hopefully, others will also be along to address your question.

    Thanks!

Hello! Keep notes of these incidents, take pictures and put dates on them. My husband and I are going through the same thing with his son. We have a whole damn portfolio full of incidents. We contacted CPS but they were no help. Police are no help, didn't even arrest the guy that punched the son in his nose. Turn to a lawyer. That's the way to go. :) I wish you luck. We know what it feels like. It hurts. The more you wait, the more the judge will think you don't care. My husbands son got abused 6 days before we scheduled a huge move to a different state. My husband got a job offer and wasn't making anything where we were. So we moved thinking that the mother of the son would leave her husband that beat the son up... but little did we know she was going behind the no contact order and styed with him. Because of the move we had little or no money at all. Barely getting by. Then there was another incident, we had someone up there that saw the child a lot and wrote EVERYTHING down that looked suspicious of abuse. Its 6 months later and we finally have enough money for a lwyer. The lawyer warned us, because we waited so long it will look bad. That's the reason why I tell you to hurry. We haven't picked a court date yet,we are praying to get him. Im afraid he won't make it next time he goes to the hospital.

    GOOD LUCK STAY STRONg

You go back to Court, prove the abuse, get the visitation Order changed. At her age your daughter will testify but the Judge does NOT have to follow her wishes. Ask that all parties be questioned and/or examined by a social worker, someone evaluating everyone with a concern for the best interests of the child.

No one here is allowed to recommend Attorneys. You can call your County Bar Association for recommendations, Attorneys who specialize. Usually the fee for the first visit is nominal and then you can decide if you want to retain that person.
