    Suing for Inheritance
    Currently my stepdad is being sued by his 3 children for their share of inheritance money. He is far away from even showing signs of passing or any of the such, so I have been wondering how this works. He is being sued in the state of Louisiana and I am not very clear on how Inheritance lawsuits work. I don't quite understand how a child can sue a parent for inheritance when the parent is still living. Please help!

    Welcome to AMHD. You are right, a child cannot sue a parent for inheritance when the parent is still living. There must be some additional facts that you are not aware of. For instance, is your stepdad the executor/administrator of the mother of his 3 children, or some other deceased family member?

    Yes, there is no case for a living person, so he will have to die for anyone to sue about his estate.

    If the stepchildrens mother passed away and did not have a will or the will was not properly done, they may have a claim against the estate of their mother in probate, and if your dad was trying to get it all, may not be able to.

    But as for as your dad's estate, not as long as he is alive.
