    My sons name is not been put on the birth certifecate.. mother put down father unknown
    Can my son get his name put on his child's birth certifecate... The mother has put down father unknown when she knows his the father... being a first time grand mother it hurts... can the mother do this and lie

    Where are you located? He might be able to petition the court for custody and visitation rights to the child; he'll have to submit to a court-ordered DNA test first.

    Once he is established as the legal father of the child, the courts will then make a ruling on custody, visitation and child support. He can request at that time to have his name added to the birth certificate.

    How does he go about this and how much does it cost... she allows him to see his daughter (for now) she knows his the father.. surley there's a law to stop mothers from lying.. admittedly they had finished when he received a text 2 weeks later to say she was 10 weeks pregnant... and my sons first reaction was he didn't want to be a father... so things have been sticky.. but when she was born he was upset and over the moon

    First of all, there is a law against falsifying a legal document. Its called perjury. But proving it and getting her prosecuted for it will be almost impossible. All she has to say is she had a one night stand near the time of conception and try and prove she didn't!

    But that's not the problem here. Your son has rights if he is the father. But he has to go after those rights. So he has to go to your local Family Court and file for joint custody and visitation. He cannot rely on her to "allow" him to see his child. Until he establishes himself as the legal father, he has no rights.

    What the cost will be depends on where you are located and whether he can do the filings on his own or needs an attorney. But he needs to act right away. Once he files for joint custody, the court will order a paternity test. If that comes back positive, then he will be declared the legal father. From there he can get court ordered custody and visitation (and she will probably counter file for support).

    Yes, all she has to say if someone tries to force the issue, is that she sleep with a couple guys and is not sure who the baby belongs to, They lie about this all the time.

    He needs to contact an attorney and find out his rights, don't trust on her just letting him see baby, that can change overnight
