    Primary Beneficiary vs. Direct Heir?
    I have recently discovered that I am the exector of my Aunts estate as well as the primary beneficiary with right of surviourship on all her accounts. Yet in her will it states that her assets are to be split 4 ways between myself and my three brothers. If I'm the primary beneficiary do I still have to split these assests with them? Or do I have a legal right to it all? How does this effect what is decided by the judge at the time its probated and I'm issued Testamentary? I have been her sole caregiver for many years now with NO assistance from anyone, especially my brothers.

    If you are on the bank accounts that is where the right of survivorship comes into play. You will take over those accounts yourself. The rest of her assets will be divided equally between the four of you because that is what is stipulated in her will.
