    Owed state income tax and child support
    We finally found my ex's employer and sent out a garnishment package. Days later I learned he owes state income taxes from 2004, when we were still legally married. If the state garnishes also for the owed income tax, which comes first. He is in arrears for child support approx. in the amount of $3,500, and $10,200 for income taxes (with penalties and interest) Also, I realize they may put a lien on my house, which I received entirely in the divorce( but we co-owwned in 2004), but don't they want the cash? He earns approx. $120,000 per year.

    In the case of income tax be it state or federal if a return is submited to either and there is a balance to be returned the debt to that municipality is paid before any arrears. Anything above that if its considered a refund then that can be taken for arrears.

    Taxes always come first. Trust me on that one! So about the house, while yes they do want money putting a lien on property is a way for them to get the money if they haven't collected it already. They can also freeze any and all assets with only ten grand to pay back it shouldn't take that long at least in my opinion because that is actually a low amount compaired to what I have had to deal with when people come to me after not filing for many years.
