    Nunk pro tunck
    My husband and I have been separated for 5 years and now he is asking the court for a nunk pro tunc divorce what are my rights

    Why is he asking for that to come about rather then just filing the final papers? Was there a mistake somewhere? Did he remarry?

    It's nunc pro tunc - it's basically an action to correct an earlier error (that's the best way I can explain it). For example, the separation papers were not filed so that the statute could begin to run.

    I agree with Califdad - was there an error somewhere, somehow?

    If he wants to file nunc pro tunc you will have to be served with legal papers - what do they say?

    "Nunc pro tunc" means "now for then" - I learned that in court last month :)

    Perhaps he wants the terms to be property settlement and division as it was when they separated, not now.

    But your rights, you can counter file, you can file motions objecting, you can do nothing and accept it
