    If one party leaves the home and a child with the parent who gets the home
    Want to file for divorce in MS and the wife move belongings from the home 11/29/09. There are two children the 18 year is with the wife and the 12 year old is with the husband. There is a loan on the car title that she drove the husband pays. Since she left the wife refuses to communicate with the husband on any issue, children, maintaining the house the loan payment. The wife talks to everyone else in the family except the husband, she talks to the sister in law and mother in law.

    The Court will decide who "keeps" the home as well as all of the other issues. Abandonment of the home/property/marriage does NOT mean the party who remained gets to keep the house.

    You need an Attorney.

    Who wants the house ? It can go to either, the 18 year old is not really a chiild, but who wants custody of the 12 year old, someone is most likely going to be paying child support also.

    So each side hires an attorney and they fight it out, in court unless they can agree before hand
