If a different state terminated my parental rights can future children be taken?
If my parental rights were termiated and they were adopted what will happen if I have another child after termination will the new child be taken immediately or would it be if there was a reason to do so? I use to live in Pennsylvania and now I live in Florida will that be an issue in a different state ?

Yes they CAN... and it would be much easier given your past history than for anyone else. But they always have to have a reason before it happens. Enough to convince the court to do it.

So this means that if I have another child in the future and my life is different for the positive from then they can still walk in after delivary and take the baby or would they have to have a reason to get involved again? And if I were married now and not then would it be sufficient if I signed custody to my husband? Or could they still take the new bby away as well?

Depending on why they took the other one away... they might or might not... in most cases its NOT automatic. And if situation that resulted in the other being taken away no longer exists... (IE- the problem was taken care of) they likely won't.

A lot depends on exactly WHY they did it he last time... unless you did something really horrific, and you were specifically told to never conceive another child... then you may be worrying about nothing.

But if you are still doing what resulted in the other being taken away previously... then it might happen.

There are a lot of "it depends" here.

As long as there is no risk to the health, welfare or safety of the child, by you or the father they likely won't do it.

OK when I was pregnant with my child in Pa I was smoking marijuana and they tested her poop and then for 8 weeks even though I honestly had not smoked since her birth jan.26,2008 they insited that my urines were still dirty so they removed her and wouldn't let me see her. I moved to fl thinking I could have a better chance at getting her back since I was starting over but, instead they terminated them saying I abonded her I have no idea what was ordered or not since I was never served with anything. Do you know how I could view that order online ? I no I did not make the smartest choices but, I have changed around 100% and am going to get married in a few months and I no he wants a family and as do I how would I find these things out? Thank you for all your help so far

When you moved to FL did you inform the PA agency? When they took the child, did they give you a list of things you had to do to regain custody? Where was the father in all this?

But, if your child was given out for adoption, then it is unlikely that will be overturned. I wouldn't even bother trying.

As to a new child, if you are married it is unlikely that anyone will just step in and take this child. Your husband will have a say in that. They would have to prove both of you unfit.

Its also unlikely that FL would even know about the PA actions, or that they would take action if they did. At most, they might have an investigator take a look, make sure the child is healthy.
