How do I file a motion of discovery to verify income
My husband's ex-wife claims to not work when it comes to child support or welfare. However, she has bought a brand new $300,000 home in her name. She has a brand new Yukon Denali and now she has also bought a brand new H3T Hummer. All of these things are in her name because her current husband has large child support arreage and she has said he has bad credit. She is also the sole owner/manager of her tattoo shop but she says that the tax returns show a loss for the shop. So when it comes to child support, she is at minimum wage. How do we go about finding the amount of income she claims when making purchases? She has to give them proof of income to be eligible for the loans she is getting. Is there a way that we can force the lenders to give this proof of income to the courts? We live in Idaho. Can we file a motion of discovery for this?

You need an attorney, you will present your evidence in court, the house, the car and require her to show the court how she gets this.

Exactly but the husband has to do this - the OP has no legal standing.

What it seems your looking for is forensic accounting to be done. That process can be very expensive to do. It also would include seizure of documents and equiptment ( like computers ). You might save yourself some money by doing the footwork yourself by a few simple steps. You can obtain public records for the home and business. You also can through legal means get a credit report on her ( it should show her income as its being reported ). Those can lead to further lines of inspection. Above all you should hire a lawyer to help you with those items. The debt to credit ratio should be found in the credit report. Getting her tax returns would help to give you a look inside as to what is going on. As a small business owner there are many ways to hide money so you must be diligent in following the paper trail.
