I live in Pennsylvania and have physical custody of my 13 year old granddaughter. My daughter passed away three years ago, so my granddaughter receives her social security. My son-in-law lives in Florida with his girlfriend and her two daughters. My son-in-law is well paid, bought a 200,000 home, belongs to the country club, the whole nine yards. We live on my social security, small pension and money from my part-time cleaning job. My son-in-law does not contribute to the support of his daughter. However, he does cover her under his health insurance but refuses to pay the co-pays. I applied for child support and venue is in Florida. My son-in-law has hired an attorney which has filed a contested answer (which I don't know what that is).The hearing was scheduled for Feb 14th. I paid for the court call, however was never heard. I was told the hearing was continued. My son-in-law tells me that I make enough money that he does not need to pay any support. My questions are:if and when I have a hearing , is my income as a grandparent considered (2)is there such a thing as a hard-ship case-my son-in-law tells me that is what he has filed for. I know nothing of Florida Child Support Laws.

What is his supposed hardship? He should have been paying support and 1/2 of medical expenses all along.

Florida laws do take into account the income of both custodial parents. So your income should be factored in.
