    My Girlfriend Left the State With My 3 Year Old Without Me Knowing
    My girlfriend told me she was taking my 3 year old boy out to the water park for the weekend and her friend told me she moved to Arizona with him! What can I do? Please help me!

    That is still considered kidnapping- have you been able to reach her? Have you contacted your local authorities?

    Does she do drugs, is she mentally stable, does she usually cause drama or make drastic decisions? I only ask this because the safety of your child may be at risk.

    Jon, I am sorry this has happened to you and I am sure that you will receive many good responses on how to deal with this. But you need to start a new thread, 'Introductions' is for saying 'Hi' and telling us a little about yourself.

    Greetings and WELCOME to the site! I just moved your question that you had posted in Introductions to this forum topic area so that it will get the most exposure to those who are best able to answer it. Introductions is for people to introduce themselves and we try to not ask questions there.

    It can be a little confusing when first learning how to use this site! Your question will get noticed much more in this forum topic area.

    How long ago did this happen ? Has she told you where she and the child are ? Are you on the birth certificate ?

    I have been dealing with a similar instance involving my newborn daughter. Local authorities do not have a great understanding of this law (parental kidnapping, and are hesitant to enforce. Here is what I have been unfortunately learned:

    1. Do you have paternity established through test or court order? If not, she is considered to have custody and can leave

    2. Do you know where they are and are the kids safe? Then they may make a follow-up call, but they won't open a kidnapping case.

    3. Why did they leave? If there is "good cause", abuse/threat, violence... they will not pursue charges.



    If you have paternity established (past the BC and AOP), and your points are valid then you need to print the statute and DEMAND they look into. They should at least have to make the phone call to gain insight and information. If the local police do decide there is a case, then have your lawyer contact the FBI, as this is interstate case, but the FBI will not get involved until there is activity locally.

    Actually, this depends on the laws in the state you live in. I know from personal experience that some states do not recognize the rights of fathers who are not married to the mother of their child. My son had to go to court just to obtain joint custody of his children so that the mother could not leave with them without his permission. If he had not done so, the state of Florida deems that the unmarried mother has sole custody of the child when it is born. Check the local statutes in the state you live in.
