    Florida Child Support - Health Insurance
    I am a non-custodial parent that is ordered to provide health insurance and pay 75% of medical expenses for my two boys. My X has refused to properly return documents to the insurance company so that claims can be paid. I am now required to pay 75% of $6000.00 of medical expenses because the insurance will not pay until the forms are received.
    If it is not specifically stated in our final divorce that she must properly file insurance claims do I have cause to file a Motion for Contempt / Enforcement or any other way to recoup monies I have to pay above what I would have to pay if she properly filed all claims for the health insurance?

    Yes you need to go back to court and have them enforce her to provide them to the insurance.

    In most cases its up to the party taking the child to be resonsible for the paperwork. Also how long ago did all of this occur ? Some states have limits as to how long things like this can go on and also how long the other party has to be notified of any medical expenses. They may be responsible for the entire bill if they are working outside the guidelines of your state.
