    Divorce and settlement of all issues depends on the issues (including pensions), the State, whether it is contested -

    Divorce rules depend on the state. Some require a separation of at least a year first, others do not. But normally the steps are.
    1. one person moves out
    2. one person files for divorce
    3. they either agree to terms or go to mediation
    4. they end up before the judge with an agreed to plan or fight it out before the judge.

    It can take from 30 days to several years.

    And always check with an Attorney before you move out to protect your rights and property and avoid an abandonment claim.
