His father is not the proper parent for him in all of it. You cane take custody of your nephew only if you are able to prove that both his parents are unfit parents.

    There are some circumstances.
Some of those circumstances may be as follows
-the child has been with the third party for a long time, or
-the home of the natural parents for some reason is not fit, or
-the parents themselves are not fit at the time that they wish the return of their child, or
-the child is old enough, such as being a teenager, and does not wish to be with this or her parents

State law varies from state to state but generally a parent is unfit when:
-he has been abusive, neglected, or failed to provide proper care for the child. A parent with a mental disturbance or addiction to drugs or alcohol may also be found to be an unfit parent.

Incarceration is an example of ground for a parent being found unfit, too.
