    Consent to take son
    I am courious, I am married and have a 14 yr old by my husband I am married to now. A few years ago when I was traveling a lot into Canada, he signed a paper that is notorized giving me permission to take my son anywhere in or outside the US. We are having marriage problem I am thinking of leaving the state with my son. Just courious would this paper stand up in court if I am to leave without husbands approval?

    That's a touchy issue...

    I am going to say probably not, since the letter was written under different circumstances, with your husband assuming he would know when and where you and your son would be traveling to.

    In the judges eyes, he/she would know the game you would be trying to play and most likely would look down upon it and it could potentially be held against you.

    Not sure, but I'm also not sure you would need it. I don't think there is anything illegal about moving out with your child in case of a divorce.

    However, it would not look good at the custody hearing. And if you don't show, the custody hearing could go against you which would give him the right to recover your son.

    Before you consider this I suggest consulting a divorce attorney.
