I am looking to find out where to start possibly without a lawyer cause I don't have much funds to pay a retainer.

But my two sons have been living with my ex hubby during the week and me on weekends..

My youngest has voiced a strong opinion that he no longer wants to live with his dad and step mom and wants to live with me.

I have no clue how to start the process if I really need a lawyer. My ex is willing to not fight with me over it and let our son have his wish.

Any advice or suggestions where to go?

My mom has the same problem with me. I am 13, and I live with my dad. I want to live with my mom, rather than my dad, step mom, and grandmother. I am treated like dirt there and I hate it. My mom can't afford lawyers either. She met a lady out of a city near us, and she was going to have to pay $50 every week. She couldn't afford it, so now I am stuck! Does anyone know the legal age in New Hampshrie, to choose who you want to live with? Please Help

Hey I am currently working as a social worker in the state of KY and we see a lot off custody issues when they turn ugly. Make sure you all are civil it is amazing how many domestic violence situation stem from these issues. Okay now as for how to legally get your daughter back.
1.) In a previous post you stated that she cried every time you make her go back! Question her as to why she is crying? Is she being mistreated? Is she simply unhappy with her stepmother?
2.) Anytime the child comes to visit you and cries you need to get a calendar and document the behavior. A pattern of unhappy behavior can be very persuasive to a judge.
3.) Call around to attorney's in the area where the divorce occurred and determine if anyone is willing to work for a small retainer and then allow you to make monthly payments. Some new attorney's are willing to do this.
4.) Most states have a form of Legal Aid contact them. This is a group of lawyer who either work pro bono or on a sliding scale.
5.) If you truly feel that you won't be able to get your duaghter because of favoritism tell the attorney to request a change of venue. Make sure to document in the aformentioned calendar each time your ex tells you he has friends in the court and that you stand no chance.

Hi, I need some advice please, I have been living in Scotland for the past 2 years but come from England, I have four children but they live with their dad, I am driving down on Friday to pick my older son up because he don't get on with his dad and his dad can't cope with him so he is going to live with me but my 12 year old wants to come and live with me but his dad won't let him, he was in tears on the phone on Sunday and it upset me, his dad keeps shouting at him and he had had enough, I don't have a soliciter because I can't afford one and I can't get legal aid because I earn too much money, is their anything else I can do, I am at my wits end, please anyone advice would be helpful from Bev

I know here in the states you can go to the local library and find books on family law. That can help you a lot, I have a friend that done her own divorce papers cause her husband is in jail. You might want to look into that and see what you can do without a lawyer. The books can show you how to draw up the papers and how old a child has to be to decide where he wants to live in your country. Good Luck! Let me know how that works for you.
