    Child support injustice
    I Live In Virginia (military). I Have A Child Support Case In Louisana That I Recently Paid Off And Ive Had Custody Of My Child For The Past Year. The System Is Still Taking Money From My Check, Holding It. And Says It Will Be Held For At Least Six Months Before They Clear Me Of The Debt And Send My Money Back To Me. What If Anything Can Be Done About This?

    Keep filing grievances until they send you you rmoney. Contact the county commissioner in the county of your child support case. Contact where you currently reside your U.S. Congressperson, your State Rep.

    Be relentless and make a ton of noise. People are not aware of the fact that states will oftentimes keep this money and never return it to the owener. The state of Michigan had over $26,000,000 in undistributed child support money and after so much time they can keep it. This is why they delay.

    If you have legal custody of your child ask for a modification of child support from the LA Child Support Services with your change of custody order. You have the right to ask for a modification every 1-3 years based on change of circumstance. That qualifies. To get it done through your command, I believe your court order would also have to show a change in the child support amount to nothing. You should be able to take that to your CO and stop having the amount removed from you BAQ/VHA. (If that's what they are calling it these days.)

    Unfortunately, you need counsel for this and in the meantime its going to cost you. There is no justice in this, you could ask your X to close the child support enforcement case with the State. If that's at all possible.
    My sister closed her case with the State Enforcement , but it doesn't always stop them from collecting money from you.

    Do CSR know that you have custody of the child? Have you proven that to them? Who are they giving the money to if you're the one that has custody of the child??

    Ok, words can be very confusing, you say you have "custody" but does that mean that you went to court and have the physcial custody of the child ordered to you, and had the child support vacated and have now asked for child support from the other party?

    Or does your term custody only mean you have the child, but have not gotten a new court order for physcial custody and have not gotten the child support order changed.

    If the child support order form the court has not been chaned, you will pay child support even if the child is actually with you, since on paper the child is still in the legal custody of the other parent.

    Legal physcial custody is a lot different than just having he child with you.

    Now this may be your case, but it just did not sound like it.

    Hello

    To You Guys Who Answered My Question. I Took Some Advise, I Ask For A Modification. Finally I Was Answered. There Was No Ligitimate Reasons For Their Actions. I Have Legal Custody Of My Child. She Been With Me Almost Two Years. Her Mother Was Paid In Full February.( La.holding The Check) I Also Found Out That They Were Not Suppose To Take My Tax Refund And Continue To Take From My Check. My Wife Has Not Work In Six Years. They Were Sent Copies Of Custody Order Papers Earlier In This Process.(im Answering Some Questions That I Read). I Felt Like No One Was Looking Out For The Best Interest Of My Child. Im Just Getting A Call Back. Needless To Say, They Will Be Sending My Money Back That They Collected For The Past Six Month. At Some Point They Will Release The Tax Refund Check(paid In Full As Of Feb.) To The Mother Meanwhile They Modified My Deduction To The Court Order Of $75 Vers $400. .
