Child support and adoption questions
I am getting married this summer. My fiancé has raised my son as his own for 6 yrs with no contact or support from my sons father. I do have a child support order in place even though he has paid for a total of 3 months out of 10 years. When I called the state of Illinois they said I have to pay $1,000 to stop the child support order even though he is going to be adopted. Why do I have to pay that? Won"t the order be void once the adoption is complete? And if not his biological father is the one who requested that he adopt my son so he doesn"t have to pay support so shouldn't he pay? I feel it is unfair to make us pay when we have been struggling for so many years without help. Is there any way to do this without it costing me the adoption fees and a huge fee to stop the order?

As part of the adoption process your child support order for any future payment will not be enforceable. But the child support order is still in place and your ex will still owe any and all back support he has not paid. ** That is his problem. Plus it is not your worry, being sure the support order is no longer active is your ex's problem
You ex will be signing all of his rights away for the adoption to happen, but it does not take effect until the adopton happens |
