    Child abandonment
    My husbands sons mother dropped my step son off with my brother in laws girl friend, the next day she brought him to our home. That was 20 days ago and his mother has made no communication with any of us regarding my step son. After a long conversation my husband and I agreed that it is in the best interest of my step son if we get physical custody of him. Is it to soon to file child abandonment & seek custody of the two year old in nys?

    You can't file child abandonment since the child was not dumped off in the street.

    You can go to court and seek custody.

    When you chose this forum to post in you would have seen a sticky note at the top of the forum dealing with this issue.

    You can file for a modification of custody. I would retain an attorney to prepare the petition for you so you give the right reasons for the change.
