    Child abandonment
    My daughter is 6 years old, her father stop coming to see her when she was just 2. He is now taking me to court to try to take custody from me:mad: . It was his choice to stop seeing her, I tried to keep things good for my daughters sake but he decided to stop seeing her, never sending no birthday cards or cards for the holidays. Now he is taking me to court. Since he hasn't seen her in over 4 years, is it considered child abandonment on his part? :confused:


    There is no way he would be able to prove me unfit. He tried to take her from me one other time and lost. The visitation he had before the first custody battle was because of me. He had her more then he actually wanted her. I found out later (after he stopped seeing her) he never had her, his mom and girlfriend did. My daughter came home at 2 years old with marijuana in her hair or on her clothes. He makes my daughter hide in fear when she thinks he is around because she is afraid that he is going to take her from us and never give her back. A 6 year old should not have to feel like that about her father! I have no problem with him seeing her and building a relationship with her, But if my daughter is not ready for that or don't want that right now because of fear then I don't think anyone should make her do it. It will take time for her to get over this fear. I think he is doing it because he wants to hurt me and my family. I am all worked up because of all of this.

    It may or may not but that's not really the issue. It will be very hard for him to take custody from you unless he can prove you unfit. Can he? Does he have any grounds for a change of custody?

    All you need to do is go into court and state that you never denied him visitation that it was his decision to stop seeing her. Unless he can prove unfitness no judge is likely to agree to a change.
