    Canadian divorce if the other party is not a canadian citizen or iimigrant
    Hello,

    I am a landed immigran here in Canada. Last year I went back to the Philippines to get married.
    For some reason, my wife, after we got married decided that she doesn't want to go with me to canada
    And decided that we should instead end our legal relationship. My question, can I file a divorce in
    Canada even if she's at my home country? Filing for divorce in the Philippines is not an option for me
    As it would take me 10 years for my marriage contract to be annulled.

    Greatly appreciate any of your advice.

    Yes you can divorce her from Canada. I am not so much familiar in Canadian law but I heard similar stories in the past. Where do you live? What province? The truth is, it's more of her problem, because you can be free, can marry anyone you like while her will be left legally married in the Philippines.

    You can also file an annulment after divorce even if it takes 10- never yrs, still it's her problem. She can't marry anyone in the Philippines on that period. You live there already.

    Thanks Superk. I live in Ontario but I am not a Canadian citizen yet, I still have 1 year to go. I intend to file an annulment in my home country as well even if it will take me a long time. I just don't want this problem to come back and bite me in the a_s. I just don't want my wonderful life here in Canada be screwed up by some stupid girl.

    Thanks again. I will be consulting lawyers nevertheless and will keep you posted.
