    Can u sue the child support agency in your county
    I have a child that was born in 94 and her father and I separated in 95. I have a support order since 95. He died in May of 2013. He owed 30,000 at $30.00 a week. He went to jail for non payment and when he got out all of a sudden he had a mental disorder and couldn't work any longer, so he went on social services. When I called the NY hotline they told me I could not take him to court on failure to pay due to him being on such services. He was protected due to him receiving welfare. When he died he had 4 children with 4 different women. As I was speaking to one of the other mothers, she informed me that she was receiving child support up to the time he died at two hundred every two weeks. through the same enforcement county. My child was getting nothing. Years ago I received his taxes and the following week I got a letter in the mail telling me that I was not going to receive any child support until I paid her back, that the money was suppose to go to her not me, I called and asked why and they told me that it depends on who's order came first. I told them mine did and they said I doubt that. I asked them to look at their files again that I have been going to court with him before his second child was even thought of. So my order came first. So I want to know since he is dead and they kept putting my child on the back burner and was giving to his second child, can I sue the support agency? I feel that it was total negligence. At his hearing the second child's mother was there testifying that if he were to go to jail she didn't know how she was going to make it cause he was paying her child support then and I was receiving 0 then. that is what put him in jail cause he willfully paid for one and not the other and it should have been split. The judge at that time stated to child support that any money's taxes etc... needed to be split I received $0.00. This is Just not right and my hand's were always tied child support and their hot line were never any help, when you call they seem like your bothering them, and can't tell you anything. Then they have to audacity to pat themselves on the back by putting how much they received in payment's and how much they sent out all these big number's to make them look good. There was a million dollar difference in what they received and what they sent out. where is that million dollars they still haven't sent out?

    I would consult with an attorney. If you have proof that you should have gotten preference because of a prior filing, you may be able to make a case.
