    Can I move out of state with my kids having no divorce
    I am a father of 2 children ages 4 and 6. I have been raising them by myself for 2 years and no divorce has been filed yet. She is suppose to be paying child support but owes 3 thousand dollars so far. She has a baby by another man. I am living in MN and so does she. I want to know if I can legally move to Texas with them without her permission.

    If you have not been to court and have not been restrained, you can go wherever you wish; the country is still that free.

    If you have no court order stating you can't (which I assume there is none because you haven't gotten divorced) then you can move wherever you want.

    But that's not saying that she won't find out and take you to court and try to order you back.

    Who said she is suppose to be paying child support ? Was this decided by a court or is it an agreement between both of you. If it were decided by a court it has nothing to do with divorce case. Children are a separate issue. Is she having visitation at this time ? Interupting that can keep you where you are. You will both have to work it out and if your child support isn't court ordered you need to get it over with and go to court on it. Get a lawyer and get help with the legal issues in your case. Again Divorce has nothing to do with Custody they ARE separate.

    Hello B:

    You now know that you can legally move...

    But, as bad as she is, she's still the children's mother and THEY need her. Stay close because that's what your children need. It has nothing to do with what YOU need. Your children should come first.

    I disagree with excon on the first part of his statement. We don't really have enough information to know if its legal or not.
    On his second part of his advice I agree totally with him. Both parents are important to a child and both need the opportunity to see the child and or corect past mistakes.
