If I am approved for Social Security disability - they said I would get a lump sum for retroactive back pay. I am in arrears for my child support - but I am current with my monthly child support payments and pay so much a month towards my arrears. Can they take my whole lump sum and apply it to my arrears balance?

Have you gone down to the Social Security Disability people and signed your kids up to get their own monthly checks from the government due to your disability? Try that. You will see that they will receive their own monthly checks in proportion to what benefit you get each month. The sooner you sign them up, the sooner they can get their own checks. Then you can see if you can't get your child support order modified accordingly.

My child's father was approved for social security disability and was paid retro for 2 years. I have always been the custodial parent. Child support enforcement told me to go to Social Security and file for my child, who also was paid retro (lump sum) for 2 years, my child will also receive a monthly check, since child is a minor, it will be in custodial parents name for the child. The parent who is applying for disability can't be forced to pay child support while they are awaiting a decision on disability, but the child support keeps accruing. (in his case 2 years) He had always had to be forced to pay his support either by garnishment or by threat of jail. That's where most of his arrearage comes from, the years before the past 2 that he was waiting on disability.

I'm waiting on a dec from social sec... my ? Is this... I have a court date on why I've not paid child support.I have med records and a apointment for charletsville va ,my doctor thinks I might have parkinsons dec as well as copd... I have cdl and was long haul and had to quit cause I caugh so hard I pass out.
