    Is adultery illegal in Wa. State?
    Is adultery illegal in Wa. State? If so would it effect an uncontested divorce? What effect may it have?

    Sure it is illegal just not sure what type of crime is it. It is felony under criminal law most likely.

    Background: Marriage is a civil contract. In 1973, Washington adopted
    The Uniform Marriage and Divorce Act and became a "no-fault" divorce
    state. Either spouse may dissolve the marriage contract and obtain a
    divorce by alleging that the marriage is "irretrievably broken."

    The court must dispose of the parties' property without regard to
    marital misconduct.

    Prior to the adoption of the uniform act, Washington was a "fault"
    Divorce state. Divorce could only be granted for one of several
    Reasons: (1) consent to the marriage was obtained by fraud or force and
    No voluntary cohabitation followed the discovery of the fraud; (2) a
    Party was incapable of consent due to insufficient age or mental
    Incapacity; (3) adultery and the action was filed within one year of
    Learning about the adultery; (4) impotency; (5) abandonment for one
    Year; (6) cruel treatment of either party by the other, or personal
    Indignities rendering life burdensome; (7) habitual drunkenness of
    Either party; (8) neglect or refusal of the husband to make suitable
    Provision for his family; (9) imprisonment; (10) living separate and
    Apart for five consecutive years without regard to fault in the
    Separation; or (11) insanity for a period of two years before filing for
    Divorce.

    She can't quote anything because she does not know what she is talking about.

    In my opinion, all anti-adultery laws in the US were invalidated when the US Supreme Court decided Lawrence v. Texas (2003)539 US 558. Anyone interested in the rights of consenting adults to have sex in private should read the case (wikipedia it for a summary).

    As to anyone who thinks adultery is illegal in WA, cite the relevant statute that says it's illegal. Then analyze the constitutionality of that statute, if it even exists in the first place, under Lawrence v. Texas.

    Ylaira, the fact is that the OP specifically asked about Washington State, not anywhere.

    Also, it's great that you want to help, but on the legal boards "I think" isn't acceptable, you have to know.

    Ylaira, if you want to discuss adultery as a felony anywhere then start a thread, it would be a very interesting discussion and would probably provide a lot of info to others.

    But there is something to argue about. There is the accuracy of the information we provide here. Your answer was not accurate and that was pointed out. You then compounded the mistake by giving a ne3gative comment that was not deserved. The issue is simple. Don't "guess" when answering technical questions.     Ran out of "Greenies" for ScottGem. The reply was/is absolutely correct. It is imperative that when offering assistance with someone in need one should do the research to be able to substantiate the particular response. There is nothing wrong with making an error where the problem arises is when needless arguing to the fact which takes away from the initial question.

    If an issue of Philippine family law arises then I'm sure we would welcome your input. But that doesn't occur very often. Further, Philippine family law is not much of a model to use to answer general questions: It's a fairly anachronistic code heavily influenced, as far as I can tell, by the Roman Catholic Church. But, don't get me wrong, I have a great deal of respect for the Philippines and its people, and in fact they have made some major reforms in the area of gay rights, which I find very encouraging and admirable, having legalized same sex sexual relations in 2004, having lifted its ban on gays in the military in March 2009, and having passed in their Lower House an anti-discrimination bill that unfortunately has not yet been implemented. But when it comes to traditional divorces and such they are very unlike the Western world.

    We take great pride in our answers on the legal boards - there is no guessing. If you post something, be prepared to back it up with facts.

    And also be prepared to answer the question, not go off in some other direction.

    This isn't about feelings. You could have caused the OP a great deal of grief by giving an incorrect answer and then continuing to defend it.

    I researched this question for someone a few months ago - I'm sure a search would find my rather lengthy answer. I found any number of Christian sites and Church-sponsored sites which said that it IS illegal in certain States. I then searched the various State laws and discovered that the Christian sites were wrong.

    I just answered the Q's of Califdadof03, I agree that it I answered what's not related to the OP's question and I must credit Alty for the word "immoral".     Again - this is the legal board, not the relationship and/or marriage board. It isn't about morals and feelings and "thinking," It's about the LAW.

    Everyone who ever posted here could consider adultery to be immioral. It wouldn't matter. It's what the LAW thinks, not a public poll.
